Welcome to QuickPOS LK. These Terms of Service ("Terms") govern your use of the Cloud Point of Sale (POS) software, databases, and reporting features developed by iNOW Solutions ("we", "us", "our"). By registering a shop or accessing the services, you ("Tenant", "User", "Client") agree to be bound by these Terms.
1. Registration and Account Approval
To utilize QuickPOS LK, users must register a valid restaurant or cafe profile:
- All new shop profiles undergo an administrative review. The default state is set to `pending` upon registration.
- iNOW Solutions reserves the right to request business verification before approving a shop.
- Accounts found operating with fraudulent info, mock details, or illegal activities will be suspended or permanently deleted.
2. Subscription, Billing, and Grace Periods
QuickPOS LK is a subscription-based cloud SaaS software:
- Subscription Plans: Pricing and quotas (max users, products, categories) are governed by the specific tier chosen during register or upgrade.
- Expiration and Renewal: Expiration dates are tracked relative to the tenant profile. Failure to renew before expiration will lead to automatic system suspension.
- Grace Periods: Suspended shops retain access to raw reporting exports for 14 days, after which writing/billing operations remain restricted until outstanding balances are cleared.
3. User Credentials and Role Responsibilities
Tenant accounts support permission roles:
- Shop Owner: Holds complete access to administrative operations, reports, cashiers, settings, recipes, and products.
- Cashier: Restricted access only to the POS Billing Register and checkout operations.
- Security: The tenant is solely responsible for maintaining credentials. iNOW Solutions is not liable for unauthorized logins resulting from poor password management.
4. Disclaimer of Warranties and Software Limits
QuickPOS LK is provided "as is" and "as available". We do not warrant that:
- The POS billing terminal will experience 100% continuous uptime without system delays. We execute routine cloud updates during low-traffic hours.
- Data computations are immune to user error (e.g. incorrect recipe values, incorrect cost logs, missing unit calculations). The system relies on accurate tenant inputs to generate P&L statements.
5. Limitation of Liability
To the maximum extent permitted by law, iNOW Solutions shall not be liable for any direct, indirect, incidental, special, or consequential damages:
- Including but not limited to loss of restaurant profits, inventory discrepancies, hardware failures, thermal printer driver issues, or customer billing errors.
- Our total liability under any provision of these terms shall be limited to the subscription amount paid by the tenant in the 3 months preceding the event.
6. Governing Law
These Terms and your use of QuickPOS LK shall be governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka. Any disputes arising out of these Terms shall be subject to the exclusive jurisdiction of the courts of Colombo, Sri Lanka.
